Christmas Truce on Evictions

Published / Last Updated on 15/09/2020

Starting legal proceedings for evictions of tenants were suspended in March but will now be opened up again in England and Wales on 21 September 2020.

However, the government has confirmed two truce periods:

  • If were the area where the tenant lives is in local lockdown and bailiffs cannot attend to enforce the eviction notice then a truce period will prevail until any local lockdown restrictions are lifted.
  • If a tenant is due to be evicted over the festive season then this will not be enforced until after the festive season unless in extreme circumstances.  The so-called Christmas Truce.

Tenants have costs and concerns.  Landlord’s too have their own costs and concerns.  You need to work together.

Our guidance to tenants:  Talk to your landlord.  Talk to the benefits agency.  Agree a ways forwards with your landlord. What about any redundancy pay – use this to pay some rent in advance?

Our guidance to landlords:  It is a repeat of the above.  Ask your tenant how they plan to pay the rent.  Are they going to talk to the benefits agency?  Agree a ways forwards with your tenant. What about any redundancy pay – use this to pay some rent in advance?
