Roberts Clark Independent Financial Solutions Limited is an Independent Intermediary and is authorised and regulated by the Financial Conduct Authority to give such advice and is bound by their rules.  Our Financial Conduct Authority firm reference number is 192598.  Certain products are not regulated by the Financial Conduct Authority.  Where this is the case we will tell you.

We reserve the right to remove any such information from the services without warning and to inform and give assistance to the relevant bodies in respect of any transgressions.

Available Information, Products and Providers

Risk Warnings

For your information and protection, please take note of the following risk warnings.  Not all will be relevant to individual contracts or policies:

For investments you make (including regular and lump sum payments)

  • Past performance should not be taken as an indication of future performance.
  • You are not certain to make a profit and you may lose money.
  • If you cash in your investment you may not get back the full amount of your investment.
  • Where you opt to receive income from an investment that is not contractually fixed at a certain rate, that income could go up or down.
  • Where you have investments with contingent liabilities you could lose all the money you invested and you may have to pay more later.
  • If your investment contains higher volatility (higher risk) funds, then your investment may be subject to sudden and large falls in value and you could get back nothing at all.
  • If your investment contains property funds, then it could invest in physical property and land.  This can be difficult to sell so you may not be able to sell or cash in this investment when you want to.  The provider may have to delay acting on your instructions to sell your investment or the holdings in the property fund.  This could be up to and in excess of 12 months.
  • The value of property is generally a matter of a valuer’s opinion, rather than fact.
  • If your investment is known as one not readily realisable then you may have difficulty selling the investment at a reasonable price and in some circumstances it may be difficult to sell at any price.  You should not invest in these types of investment unless you have carefully thought about whether you can afford it and whether it is right for you. 
  • If your investment has charges at the start of the investment, then if you cash it in or surrender it in the early years you may get back less than you invested.  There could be a surrender penalty for cashing in any investment within the first five years (or more).
  • If your investment contains with profits funds, then the value of the policy will depend on how much profit the provider makes and how they decide to distribute that profit.  In times of poor stock market conditions, the product provider could impose a Market Value Reduction (also known as a Market Value Adjustment) to the value of your investment, meaning a lower cash in value than its face value.  This is to ensure you only receive your fair value from the fund.
  • If your investment is exposed to foreign currencies, then the rates of exchange between currencies may cause your investment or any income from it to rise or fall.

For Life Insurance Policies

  • You should make sure you understand which benefits of the policy are fixed and which benefits of the policy are not fixed.  Make sure the policy does what you need it to and that you are eligible to make a claim.

For Income Drawdown and Short Term / Investment Linked Annuities

  • The value of your fund may be eroded, especially if investment returns are poor and a high level of income is taken.  This could result in a lower income in the future. 
  • The investment returns may be less than those shown in the illustrations.
  • Annuity or scheme pension rates may be at a worse level in the future.
  • When maximum withdrawals are taken or the maximum short term annuity is purchased, high levels of income may not be sustainable.

Taxation

  • You should be aware that levels, bases and reliefs of taxation can change and you should seek advice regarding your personal taxation circumstances in respect of any financial contract or policy.

Our Services

Whilst we use all reasonable endeavours to keep the sites up to date, there may be a period of time between legislative changes, a product provider changing rates, altering product features, withdrawing or launching new products and the time we are notified of such a change and are able make necessary changes to the said websites.  This is particularly the case when base rates change or other major financial events occur.  We cannot be held responsible for any such delays.

We reserve the right to change the content, presentation, performance, user facilities and availability of any part of the sites at our sole discretion.  It is your responsibility to refer to the changes.  They will come into effect immediately on posting.

Exclusion of Liability

The sites are provided 'as is'.  All warranties whether express or implied under law including without limitation any warranty for the information, data, services, interrupted use, errors, omissions, delays, termination of service, loss of data for any reason, fitness of purpose, infringement of third party property rights are hereby expressly excluded with the sole exception that no exclusion of liability is claimed of death or personal injury as a result of negligence by us.

All reasonable endeavours have been taken to ensure that the information published on the sites is accurate.  However, we do not warrant that the information is accurate or complete.  You are advised to discuss your specific requirements with an independent financial or legal professional.

You accept that we shall not be liable in any event for any direct, indirect or consequential loss or damages arising from use of the sites.

You irrevocably indemnify us from and against any and all losses, damages and costs suffered or incurred of whatsoever nature arising out of or in connection with your use, provision or distribution of information or any part of the sites or any part or otherwise howsoever arising in relation to any breach of this agreement by you.  This indemnity shall not apply to any loss or liability to the extent that it arises or results from any contravention of the Financial Conduct Authority rules or Financial Services and Markets Act 2000.

We do not make any warranties expressed or implied as to the accuracy, adequacy, quality or fitness for any particular purpose of the information or the sites for a particular purpose or use and all such warranties are expressly excluded to the fullest extent that such warranties may be excluded by law.  You bear all risks from any uses or results of using any information.  You are responsible for validating the integrity of any information received over the internet.

You agree not to hold us liable for loss caused directly or indirectly by any exchange or market ruling, government restriction or any “force majeure”.  This includes but is not restricted to floods, fires, abnormal weather conditions, earthquakes or other “acts of god”, wars and riots, power and equipment failures or any other cause beyond our reasonable control.

Third Party Exclusion of Liability

You acknowledge and agree that certain information within the sites is provided by third parties and that we have no control over the accuracy or completeness of such third party data.

The third party links on FinancialAdvice.net may take you to other sites where trading is possible.  You acknowledge and agree that we shall not be responsible or liable with regard to any advice or trading which may be conducted on such third party sites.  The information and services offered within these sites has been produced by companies independent of us who may not be regulated to conduct investment business.  We therefore take no responsibility for and give no warranties, guarantees or representations in respect of third parties and linked sites.

Linking to the Sites

Anti Money Laundering

We have certain responsibilities under Money Laundering Regulations to verify the identity and address of clients and may need to make certain enquiries and obtain certain information from you for that purpose.  You confirm that all information you supply will be accurate and that we may pass on such information, as we consider necessary to comply with any legal or regulatory reporting obligations we have.

You agree that we may disclose to the Financial Conduct Authority and to any other regulatory authority to which we are subject and to any person empowered to require such information by or under any legal enactment, any information they may request or require relating to you or, if relevant, any of your clients.

Complaints

If you have any complaint about our performance under this agreement you should direct that complaint to the Compliance Officer of us who will investigate the nature of your complaint and try to resolve it.  In respect of regulated activities as detailed in the Financial Services and Markets Act 2000, if you are not satisfied with the outcome of our investigation, you will have the right to refer your complaint to the Financial Ombudsman Service if it is within their terms of reference and jurisdiction.  A copy of our complaints handling procedures is available on request.
