Following a lost Court of Appeal case to extend compensation for unfair dismissal to financial loss and mental distress, Unison has hit out at the Government with criticism.
Unison believes that where an employee has suffered mental distress at work and been unfairly dismissed, that person should not just be compensated for the loss of earnings. Unison commented that the Lords had missed an opportunity to make the law on dismissal a lot fairer.
Our View
More and more people are taking their employers to tribunals and, according to recent surveys, the majority of people would lie, just to get more money. The more compensation open to employees, the more they will twist the system to get at that money.
Whilst no one should have to suffer bullying or victimisation at work, or indeed unfair dismissal, the compensation must be fair. For the honest employee that has been victimised, they deserve more than is currently on offer. The sad truth is that the unscrupulous employees will mean excessive compensation being claimed and paid out.
