There are various costs that will be involved when arranging a divorce - you need to be aware of them all to prepare financially as costs can mount significantly.  Some of the costs are detailed below.  Remember part of these costs and fees may be covered by a legal aid scheme now the Legal Services Commission (if you are eligible).  

Court and application costs *    

  • Application for a divorce, official separation or to have a marriage annulled £180  
  • Filing responses/answers and cross-petitions £100  
  • Applications under the Children Act £90  
  • Registering Maintenance £30  
  • Injunctions £60  
  • Application for a detailed assessment £160  
  • Making the decree absolute £30

The Court Service website publishes many leaflets to help with divorce and also gives guidance on the up to date fees.  

Solicitors fees

These will vary depending upon the solicitor that you instruct.  Some may charge higher fees than others if you use a higher profile solicitor's practice.  Costs can range from anything as low as £50 or £60 per hour through to £250 per hour plus.  This is a personal matter for you to agree with your adviser.  They will normally give you an estimated overall cost of the whole case.  Solicitors fees are normally subject to VAT (assuming they are VAT registered) and you should be aware of this when looking at the quoted costs.  Some solicitors may charge a flat fee for a divorce package. 

Alternatively, if the divorce is to be undefended it may be that you opt for a DIY divorce package which again, a number are available today.

Pensions valuations service

Property valuation fees and other professionals that you may use will be subject to individual negotiation.  Again, you may expect some form of hourly rate, a flat fee or as far as pensions are concerned, it may be that a commission is taken on any resultant transfer of pension rights rather than a fee, it will still be your choice though.

Barristers fees

Again these will vary depending upon who is instructed.  A typical barrister will charge on a daily basis to act as counsel at court.  Costs will range from anything as low as £300 plus VAT upwards depending upon the barrister that is used.  Barristers are normally contacted and instructed by the solicitor.
