At the £1.7 billion Equitable Life High Court hearing recently, the law firm Herbert Smith who are representing Equitable, found itself in the firing line. The defendants rounded on both Equitable Life and Herbert Smith alleging that non-disclosure of documentation had prejudiced their case. They accused the claimants of playing 'a quite inappropriate legal game' which meant cross-examination of witnesses had to take place without the relevant documentation.
