Halifax Borrowers _ Don't Be Misled

Following news from Halifax on refunds and goodwill gestures, the Financial Services Ombudsman has again stamped its foot.

Halifax, in letters to borrowers, said that if they had not claimed their refund by 1 February 2002, they were not entitled to it.  They would just be given £100 compensation.  A Halifax spokesman said that any claims from 1 February 2002 would be rejected.

The Financial Services Ombudsman said that these letters may have misled borrowers to the conclusion that they had no right to complain, which is obviously not true. The Ombudsman also said that Halifax had incorrectly interpreted their ruling and that "consumers can come to the Ombudsman if they feel they have a case.  Whether or not it will be upheld is another matter".
