Retirement Age Discrimination

Published / Last Updated on 30/11/2007

Heyday

Pensioner organisation Heyday had been hoping to challenge the United Kingdom’s default retirement age on the grounds of age discrimination.

However, the European Court of Justice ECJ has recently ruled, in Spain, that a mandatory state retirement age was not discriminative as long as it could be objectively justified.

Our view

Heyday may still have a chance, although we believe success is unlikely, as each case is judged individually.  We suggest the pensioners use their own collective buying and voting power to vote their own politicians in and to establish their own businesses to trade with each other.
